There is, so far, no authority in the Czech Republic that would co-ordinate and supervises the observance of children's rights in the country. Civil rights and liberties. Children have the right not to be subjected to abuse or other cruel, inhumane or degrading treatment or punishment. Our country lacks a sufficient and interconnected system of help for tortured and abused children. Children are still subject to physical punishment and harassment. Family environment and alternative care. Enforcement of the right of children to be cared for by both parents, and for contact with the other parent after divorce or separation, particularly by the father, is not sufficiently ensured. The policy of care for children who have suffered the break-up of their family unit prefers institutional care and insufficiently supports assistance to the actual families of children and foster care families. Special protective measures. Underage asylum-seekers who stay in the Czech Republic without their parents have their specific problems. There is no sufficient system of help for child victims of commercial sexual abuse. Stories Štepánka… A seven-year-old girl with above-average intelligence (IQ116) was sent by the court to an institute for children under three years of age, where she spent six months, despite interventions, without going to school. A complaint against her situation was passed on to the District Authority, where the social worker assigned to the case submitted a proposal for placement of the girl into an orphanage. The case was then passed on to a court, which issued a ruling about the placement, and then onto another District Authority, which administers the orphanage where she was to be placed. The case was then passed on to The Ministry of Health, which provides guidelines for institutions handling the care of children under three years of age. The fifth ministry to hear the case was the Ministry of Education, which should examine children and recommend their placement in suitable institutions, and the sixth ministry to hear the case was the Ministry of Labour and Social Affairs, which oversees social and legal protection in District Authorities. Finally, the case was brought before the Ombudsman. Despite a court ruling, the father of Štepánka (*1994) has not allowed her any contact with her mother since 1997. After three and a half years of court disputes, Štepánka was finally placed into the custody of her mother by the Court of Appeals in January 2000. The father refused to comply with the court ruling. The District Court ordered the execution of the ruling by removing the daughter from her father only in January 2001. By September 2002 the decision still had not been realised. The father and his daughter are currently in hiding. |
