Zivno or permanent residency for spouse

Hello, I am a U.S. citizen marrying a Czech man in February. If if apply for a Zivno now, do I have to change to permanent residency in Feb.? If so, looks like I have to return to U.S. during application process which we will do what we have to do.

If I wait until marriage AND until I receive resident visa for spouse, does this visa also allow me to work or do I have to apply for a Zivno or a work permit? For both questions (Zivno or resident permit for spouse), do I simply fill out the form attesting to no criminal record or do I have to obtain a clear criminal record form in the U.S.? It appears by everything I've read that I simply fill out the form that affirms I have no criminal record.
